COVID has presented school districts and their transportation contractors with unique challenges and significant uncertainty. Most bus contracts that were in effect at the start of the pandemic did not adequately describe the parties’ rights and obligations under the circumstances. This presentation will discuss options for addressing such deficiencies, taking into account factors such as potential school closings, payment obligations, federal and state relief funds, etc. By negotiating modifications to their bus contracts, both school districts and their contractors can gain a better sense of certainty should COVID or other unanticipated circumstances present themselves in the future.
