Attorney Robert Simandl, of von Briesen & Roper, s.c., will discuss the issues for employers in the decision to hire someone as an “employee” or as an “independent contractor.” With State of Wisconsin initiatives and federal law enforcement against employers who attempt to avoid the encumbrances of hiring “employees” has escalated in recent years creating significant legal and financial exposure for employers. Bob will discuss the federal and State requirements for independent contractor status as well as the consequences at failing to meet those statutory obligations. He will also discuss ways to help minimize the liability associated with hiring “employees,” especially for limited term assignments. The learning objectives for the program include: 1. Understanding the obligations which must be present for a true “independent contractor” relationship. 2. Document, Document, Document – How to minimize your exposure on audit of persons hired as independent contractors. 3. Steps to take in hiring employees through the on-boarding process to reduce exposure for employee claims. 4. Do’s and Don’ts in the independent contractor/employee decision process. 5.
